Board of Commissioners holds public hearing on four new subdivisions

FORSYTH COUNTY, Ga. — The Board of Commissioners will consider requests from developers to rezone property for four new subdivisions when it meets Thursday at 5 p.m. in the County Administration Building in Cumming.
Toll Brothers, Inc. ZA 4037 is a request to rezone115.253 acres for 128 residential lots and ZA 049 is a request to build 60 residential lots on 48.616 acres.
Century Communities of Georgia has requested rezoning on 88.45 acres for 105 residential lots and MKW Capital. LLC has applied for rezoning to accommodate building 92 lots on 104.3 acres.
In other public hearings, the Board will consider:
- Approval of an Alternate Design for KFCRE, LLC and variances to UDC 12-13.13(A) and UDC 21-8.6(A)(5) – Parcel 108-075 – AD220003;
- A request for an Amendment of Zoning Conditions on ZA2699 (Aaron J. Land) by Chris Cowart Properties, LLC with variances;
- Approval of a Sketch Plat for Sri Rama Temple – Parcel 131-026 – SP210014;
- A County-Initiated request to rezone from Single Family Community Residential District (CR1) to Single Family Residential District (RES2) Conservation Subdivision on 36.6895 acres – Parcel 081-666 – ZA4042;

The Board will also hold an Administrative Hearing in reference to an appeal of a denial of an alcohol application to sell beer, wine and distilled spirits by the package for Anushka Corporation dba Liquor Locker located at 2350 Atlanta Highway.
BOC approves Toll Brothers request to build 35-lot subdivision near Castleberry Rd.

FORSYTH COUNTY, Ga. – Thursday’s Board of Commissioners meeting lasted just under two hours and was fairly uneventful until the final agenda item – an administrative hearing regarding an appeal by a long-time liquor store owner who was denied renewal of his license.
Commissioners did approve Toll Brothers request to rezone 33.6 acres just south of Castleberry Road from A1 and CBD to Res 2 for 35 residential lots and several issues were postponed, including a resolution that would allow commissioners to be employed by another municipality and a moratorium on acceptance of requests for conservation subdivisions.
An attorney for the Liquor Locker claims his client was denied renewal based on the existence of a child care center nearby. But the attorney said that in order to deny the applicant’s request for renewal the child care center must be receiving state funds which was not the case.
The denial notice to the applicant stated only that the child care center had “expressed and interest in receiving state funds,” he said. “They couldn’t have. They didn’t even have their state license yet. No students were enrolled. No classes were being offered. Therefore the county should not have denied the renewal.”
Commissioner Todd Levent said, “We have a lot of these little private schools in our community what we have liquor stores next to them because they don’t receive state funds.”
Levent also asked the county attorney if a form letter explaining the applicant’s right to appeal had been included with the notice of denial as required by the county code. The answer was that it had not.
The issue was then postponed until next month’s meeting.
Toll Brothers Green Acres Development is set for public hearing Thursday

FORSYTH COUNTY, GA. – Toll Brothers, Inc. will request an amendment of zoning conditions on ZA3249 Green Acres Development, Inc. (parcels 010-098 and 010-139) when the Board of Commissioners holds a regular meeting and public hearings Thursday at 5 pm in the County Administration Building.
The proposed development consists of 95 single-family detached dwellings located on 58.434 acres at Coppice Drive and Howard Road.
In other public hearings, the Board will consider:
- A request for an Alcohol License to sell malt beverages (beer), wine, and distilled spirits by the package on the premises for Golden Liquor LLC dba Blue Glass Liquor and Wine located at 6015 Post Road;

MOU with Toll Bros. is a win for all parties

FORSYTH COUNTY, Ga. – County Commissioners put a long-standing issue between the county, Toll Brothers and the Forsyth Water and Sewer Authority behind them by unanimous approval of a memorandum of understanding (MOU) Thursday.
County Attorney Ken Jarrard said the agreement is a win-win-win for all parties. Actually, it could be considered a winX4 since the agreement not only pleases the signatories, but the residents of the nearby subdivision who will get a new park in the bargain.
The county purchased Parkstone Water Reclamation Facility and the 18.2 acres it sits on for $2.5 million — $546,000 for the acreage — and held it in a trust for the Water and Sewer Authority. Toll Brothers held a first right of refusal. Under the MOU, however, Toll Brothers agrees to give up its right so long as the county builds a park and recreation facility on the property. Also, since the facility was held in trust for the Authority, the county agrees to reimburse the Authority for the amount of the land, $546,000.
In other business, the Board elected District 4 Commissioner Cindy Jones Mills as Chairman for 2021. District 1 Commissioner Molly Cooper will serve as vice chairman and District 2 Commissioner Alfred John will serve as secretary.
Commissioners unanimously approved an extension of the Family First Coronavirus Relief Act that expired Dec. 31 until March 2021.
EMA Director Chris Grimes provided an update of the COVID-19 situation. Gov. Brian Kemp extended his executive regarding who may receive the vaccine last week to include those 65 years of age an up as well as firefighters and law enforcement officer.
Grimes said Georgia Public Health Departments began taking appointments but they filled up fast. The problem Gaines added is there are not enough people to administer the vaccine.
“That’s been holding us back,” he said. “We’re looking to help DPH expand their capabilities and we have received approval for our paramedics and fire department to assist in dispensing the vaccine.”
The Board unanimously approved a Finance Department request to make an application to the U.S. Department of Treasury to participate in the federal government’s Rental Assistance Program. If the application is accepted the issue will come back to the Board of Commissioners for final approval.
During the public hearing portion of the meeting, commissioners approved a county-Initiated request to conduct around the clock business hours in warehouses/offices totaling 279,562 sq. ft. in Corporate Court and an amendment to zoning conditions requested ty Eagle Land Group Inc. that a 50 foot buffer be reduced to 40 feet to allow for a backyard pool.
They also held a first public hearing on proposed changes to the alcohol ordinance regarding server permits. Staff recommended an increase in the permit fee from $25 to $50 but, if approved following a second public hearing, servers will only have to renew the permit every two years. In the past anyone convicted of a felony would not be eligible to receive a permit. If the change is adopted, the felony conviction would have to have occurred in the last five years.
