Attorney Randy Rich will serve as mediator in LOST negotiation

FORSYTH COUNTY, Ga. — County Commissioners is expected to announce the hiring of attorney Randy Rich to serve as the Local Option Sales Tax (LOST) mediator between Forsyth County and the City of Cumming when the Board meets in a regular session Thursday Sept. 1 at 5 p.m. in the County Administration Building, 110 East Main Street in Cumming.

The Board will also conduct the following public hearings:

County millage rate will remain unchanged but tax digest grows by 13.46 percent

FORSYTH COUNTY, Ga. — The Forsyth County Board of Commissioners will maintain the current Maintenance & Operations, Bond and Fire millage rates with no change.

The proposed County Maintenance & Operations rate is 4.791 mills. The proposed
Fire rate is 2.175 mills. The proposed Bond  rate is 0.930 mills.

These rates will fund the County’s 2023 budget, which is being developed. A growth of 13.46% in Forsyth County’s tax digest means that, while the county is maintaining the same
millage rates with no change, the anticipated total collections will increase. Of the 13.46% growth, 4.62% is due to new construction in 2021 and the remaining 8.84% comes from increased values from reassessments.

Any change in an individual tax bill will depend upon the change in assessed valuation for that property, and the value of any Homestead Exemption, which may also change with the assessed value. When the total digest of taxable property is prepared, Georgia law requires that a rollback millage rate must be computed that will produce the same total revenue on the current year’s digest that last year’s millage rate would have produced had no reassessments or growth occurred.

Due to the growth in the tax digest, Maintenance & Operations taxes will increase by a net 8.44% over the rollback millage rate. The preliminary 2023 budget presented to the Forsyth County Board of Commissioners is based on a millage rate higher than the rollback millage rate, therefore before the Board of Commissioners may set a final millage rate, Georgia law requires three public hearings to be held to allow the public an opportunity to express their opinions on the increase.

All interested citizens are invited and encouraged to attend the public hearings:
Thursday, July 7 at 11 a.m.
Thursday, July 7 at 5 p.m.
Thursday, July 21 at 6 p.m.

All three public hearings will be held at the Forsyth County Administration Building located at 110 E. Main Street, Suite 220, in Cumming. Adoption of the millage rate is slated for July 21 at 6:30 p.m. as part of the Board of Commissioners’ regular meeting.

County Commissioners says no tattoo parlors in three overlay districts

FORSYTH COUNTY, Ga. — Despite the passionate pleas of two professional tattoo artists and support from Commissioner Laura Semanson, the Board of Commissioners chose to bar tattoo parlors from three overlay districts in Forsyth County during Thursday’s public hearings.

The vote was 4-1 to keep those businesses out of the overlay districts of Atlanta Highway/McFarland Parkway/Mulinax Road, Peachtree Parkway/Bethelview Road and Campground Castleberry/Kelly Mill/Post Road.

Russ Abbott argued, “The most desirable commercial real estate is in those districts. I need to know if I put a high-end, custom tattoo studio in this county I can be successful. I need to be able to bring in tattoo artists from around the country to work in this studio.”

Tattoo artist Rob Ingram who lived in Forsyth County for many years before moving to Dawson County said, “There are so many reasons why limiting where I can place a studio is wrong.I shouldn’t have to worry about where I can open a studio because I am not welcome in an overlay district.”

Semanson said, “I don’t see the need to put a blanket-type prohibition. I personally feel that is unfair. The county is given the tools to regulate businesses during the conditional use permit process (CUP). To me that is all that is needed.”

Commissioner Todd Levent and the others were not swayed. Levent said the overlay districts comprise only about 10 percent of the county. “I’m not interested in tattoo parlors going into these overlay districts.”

 

 

Board of Commissioners holds public hearing on four new subdivisions

Toll Brothers, Inc. ZA 4037 is a request to rezone115.253 acres for  128 residential lots and ZA 049 is a request to build 60 residential lots on 48.616 acres.

Century Communities of Georgia has requested rezoning on 88.45 acres for 105 residential lots and MKW Capital. LLC has applied for rezoning to accommodate building 92 lots on 104.3 acres.

FORSYTH COUNTY, Ga. –  Board of Commissioners will set qualifying fees for candidates for public office when it meets in a regular meeting and public hearings Thursday (Jan. 20) at 5 p.m. in the County Administration Building, 110 East Main Street in Cumming. The General Primary Election and non-partisan election date is set for May 24, 2022.

Other public hearings to be held include:

FORSYTH COUNTY, Ga. – The Board of Commissioners will hold a public hearing on a County-initiated request to rezone 21.259 acres at 2150 Antioch Road from Agricultural District (A1) to Commercial Business District (CBD) when it meets for a regular meeting/public hearings Thursday at 5 p.m. in the County Administration Building, 110 E. Main Street in Cumming.

The purpose of the request is to accommodate the 31,000-square feet non-profit Boys and Girls Club of Lanier that will include 10,000 square feet of ancillary uses, athletic fields, and 142 parking spaces. the following variances will also be requested: 1.) Increase the maximum building height from 30 ft. to 40 ft. (UDC Table 12.2); and, 2.) Reduce the zoning buffer along the northern property boundary from 40 ft. to 35 ft. Forsyth County Board of Commissioners to hold public hearings today

FORSYTH COUNTY, Ga. – The Forsyth County Board of Commissioners will consider Fill Ministeries, Inc. request to build a place of worship (5,407 sq. ft. chapel) with ancillary uses when it meets today (Tuesday Dec. 2) in the County Administration Building at 2 p.m.

Ancillary uses include a fellowship/meeting hall, pavilion/bathrooms, shed, office, minister’s residence, and food pantry in buildings totaling an additional 29,991 sq. ft. with 104 parking spaces on 3.03 acres currently zoned Agricultural District (A1) – Parcel 251-005.

During a recent Planning Commission hearing, District 5 Commissioner Nedal Shawkat said, “This is a charity or non-profit that would like to not only grow aquaponic produce in greenhouses and have it distributed. They would also like to have a facility on this parcel to allow the warehousing, processing, packaging and distribution of products not produced on the premises. “This is not an appropriate location for a commercial enterprise.”

Commissioners will also hold a public hearing regarding amendments to Chapters 3 and 12 related to Specialty Pharmacy within the Unified Development Code of Forsyth County. Typically pharmacies design medical compounds other than medical marijuana. A pharmacy that wants to become a specialty pharmacy would have to obtain a state license and a Forsyth County conditional use permit (CUP) before it could dispense medical marijuana.

FORSYTH COUNTY, Ga. – A rezoning request for a major new sports complex will return to the agenda Thursday when the Board of Commissioners meets Thursday at 5 p.m. in the County Administration Building, 110 East Main Street in Cumming.

Georgia Sports Arena, LLC – ZA4012 has requested 13.92 acres near the intersection of Valley Circle Road and Atlanta Highway be rezoned from Neighborhood Shopping District (NS), Single Family Residential District (R1) and Commercial Business District (CBD) to Commercial Business District (CBD). The purpose of the request is to accommodate an office, retail trade establishment, a 6,000 sq. ft. restaurant and a 55,600 sq. ft. indoor commercial recreational facility with a Conditional Use Permit (CUP) for outdoor commercial athletic fields with 315 parking spaces. Forsyth County Millage rate to remain unchanged; public hearings scheduled for July

FORSYTH COUNTY, Ga. – The Forsyth County Board of Commissioners today (June 22announces its intention to maintain the County’s Maintenance & Operations, Bond and Fire millage rates currently in place with no change. Due to the growth in the tax digest, Maintenance & Operations property taxes levied by the County this year will increase by a net 1.98% over the rollback millage rate.

The proposed County Maintenance & Operations rate remains unchanged at 4.791 mills. The proposed Fire rate remains unchanged at 2.175 mills. The proposed Bond rate remains unchanged at 0.930 mills.These rates will fund the County’s 2022 general operating budget, which is currently in the preliminary stages of development. Forsyth County continues to have millage rates among the lowest in metro Atlanta.

A growth of 4.54% in Forsyth County’s tax digest means that, while the County is maintaining the same millage rates with no change, the anticipated total collections will increase. Of the 4.54% growth, 2.52%is due to new construction in 2020 and the remaining 2.02% comes from increased values from reassessments.

Any change in an individual tax bill will depend upon the change in assessed valuation for that property and the value of any Homestead Exemption, which may also change with the assessed value. When the total digest of taxable property is prepared, Georgia law requires that a rollback millage rate must be computed that will produce the same total revenue on the current year’s digest that last year’s millage rate would have produced had no reassessments or growth occurred.

The preliminary 2022 budget presented to the Forsyth County Board of Commissioners is based on a millage rate higher than the rollback millage rate, therefore before the Board of Commissioners may set a final millage rate, Georgia law requires three public hearings to be held to allow the public an opportunity to express their opinions on the increase.

All concerned citizens are invited and encouraged to attend the public hearings:
Thursday, July 8 at 11 a.m.
Thursday, July 8 at 5 p.m.
Thursday, July 22 at 6 p.m.
All three public hearings will be held at the Forsyth County Administration Building (110 E. Main St.).

Adoption of the millage rate is slated for July 22 at 6:30 p.m. as part of the Board of Commissioners
regular meeting.
