First two public hearings on the proposed millage rate are in the books

FORSYTH COUNTY, Ga. — Chief Financial Officer Marcus Turk presented the FY 2022 proposed millage rates at the first two of three required public hearings on Thursday morning. The second was held Thursday evening.

The county’s proposed rate is 7.896 mils, the same as last year. The proposed budget is $186,100,000, a 13.4 percent increase over last year’s adopted budget.

Turk said he anticipates revenue of $186,100,000 and expenditures of $180,566,670, with $5,533,330 available to be added to the county fund balance.

The tax digest that was finalized on May 26 showed a total increase from $16.7 billion last year to $20.38 billion this year.

But the county’s millage rate tells only a small part of the story. The school system has approved a millage rate more than double the size of the county’s at 18.718 mils, including bond pay back. Total millage rate for residents of Forsyth County: 27.614 mils.

Only one person spoke out against the county’s millage rate during the morning public hearing. Steven Schroeder, a resident of Vickery Village, said, “The millage rate should be discounted by 10-12 percent due to the exorbitant amount of assessed value that has been imposed by the (Tax) Assessor’s Office.”

Schroeder added, ” I know personally of 21 property owners in my community of Vickery Village that have filed appeals because their assessed value has been overstated.”

No one spoke in opposition to the millage rate in the evening session.

Commissioners will consider changes to Animal Control Ordinance Thursday

FORSYTH COUNTY, Ga. — Forsyth County Commissioners will hold a public hearing to consider an amendment to the county ordinance regarding modifications to the Animal Control ordinance when they meet in a regular session with public hearings Thursday (June 16) at 5 p.m. in the County Administration Building, 110 East Main Street in Cumming.

The modifications could establish requirements for offering animals for adoption at pet shops, prohibit the outdoor sale of animals, provide authority for the enforcement of the ordinance, and establish penalties for violations.

The Board is expected to adopt an amendment to the Forsyth County enabling legislation that would allow a BOC member to hold an official position in another municipality that is not within County limits or where the municipality does not share a border with Forsyth County.

Under old business the Board will consider:

  • A County-Initiated variance to: 1.) Reduce the exterior buffer from 40 ft. to 20 ft. adjacent to tax map/parcels 130-048 and 130-069 adjacent to the existing driveway only (UDC 16-4.6(C)) – Parcels 130-068 and 130-049 – VA220034;
  • Surya Realty LLC  request for ZA4034 to rezone from Agricultural District (A1) to Single Family Residential District (RES3) on 18.30 acres for 26 residential lots with a density of 1.42 units per acre with the following variance to: 1.) Reduce the exterior buffer along the southern and western property boundaries from 25 ft. to 0 ft. (UDC Table 11.2(b)) – Parcels 102-005, 102-075, 102-119, 102-076, and 102-062;
  • (3) Toll Brothers, Inc. request for ZA4037 to rezone from Agricultural District (A1) and Single Family Residential Restricted District (R1R) to Single Family Residential District (RES2) Conservation Subdivision on 115.253 acres for 128 residential lots with a density of 1.11 units per acre with the following variances to: 1.) Reduce the minimum building setback from all primary conservation areas for lots 18, 19, 20, 36, 37, 38, 39, 40, 41, 64, 65, 66, 67, 101, 114, amenity area, and stormwater ponds 1 and 2 from 75 ft. to 0 ft. (UDC 19-5.1(D)); and, 2.) Reduce the minimum number of lots entirely abutted by open space on at least one side from 85% to 70% (UDC 19-5.1(C)) – Parcels 145-073 and 145-021;
  • A County-Initiated request to rezone from Agricultural District (A1) to Restricted Industrial District (M1) for industrial buildings totaling approximately 383,281 sq. ft. on 36.761 acres – Parcels 236-029 and 236-093 – ZA4071;

Under New Business, commissioners will consider:

  • Long Phan request for a conditional use permit CP210047 to build a 2,000 sq. ft. detached accessory apartment on 0.72 acres zoned Single Family Residential Restricted District (R2R) with the following variances to: 1.) Increase the total floor area of all accessory buildings and structures on a lot from fifty percent (50%) to ninety percent (90%) of the total floor area of the primary building on that same lot (UDC 11-9.7(C)(6)(b)); and, 2.) Reduce the side setback adjacent to tax map/parcel 155-116 from 10 ft. to 5 ft. (UDC Table 11.2(a)) – Parcel 155-115;
  • New Heights Academy, Inc. request for a conditional use permit CP220009 to operate a 3,465 sq. ft. private school in an existing building with 19 parking spaces on 5.90 acres currently zoned Commercial Business District (CBD) – Parcel 019-154;
  • Jamie Hobbs’  zoning application ZA4048 to rezone from Single Family Residential District (R1) to Commercial Business District (CBD) on 4.515 acres with Conditional Use Permits (CUPs) for an open air business and a contractor’s establishment in buildings totaling 3,941 sq. ft. with 43 parking spaces with the following variances to: 1.) Reduce the zoning buffer adjacent to tax map/parcel 191-063 from 40 ft. to 10 ft. for the existing structures and gravel driveway only (UDC Table 12.2); and, 2.) Reduce the zoning setback adjacent to tax map/parcel 191-063 from 50 ft. to 10 ft. for the existing structures only (UDC Table 12.2) – Parcel 191-062;
  • Appointment of Kathy Autry to serve as the District 2 Representative on the Forsyth County Board of Assessors.

Public will hear county’s plan to reserve sewer lines for commercial projects during today’s public hearings

FORSYTH COUNTY, Ga. – The public will have an opportunity to weigh in on the county’s plan to invest up to $19 million to build a sewer infrastructure reserved exclusively for commercial and industrial projects when the Board of Commissioners holds a regular meeting with public hearings today at 5pm in the County Administration Building, 110 East Main Street in Cumming.

Funding would come from the $47.37 million the county received from the American Recovery Plan. County officials say the plan would generate many times the investment in new tax revenue.

In other public hearings, the Board will consider:

  • An Alternate Design for Rene Melendez – Parcel C20-030 – AD210008;
  • The request for variances to the UDC Section 11-9.6(J)(1) by Toll Brothers, Inc. – Parcels 156-001 and 156-002 – VA210103;
  • The request for an Amendment of Zoning Conditions on ZA2699 (Aaron J. Land) by Chris Cowart Properties, LLC and variances to UDC Table 14.2, UDC 14-4.13 and UDC 10-1.10(A)(1) – Parcel 063-057 – AZ210045;

Under New Business the Board will consider a County-Initiated lot width variances related to the Res2 portion of ZA3997, such that the existing Res2 lot yield may be maintained, but that none of the development or access to the development will occur from Olde Field Chase Subdivision; the number of lot width variances to be determined.

BOC to set FY 2022 budget Thursday

FORSYTH COUNTY, Ga. — County commissioners are expected to approve a resolution to adopt the FY 22 budget when they meet in a regular session Thursday at 5 p.m. in the County Administration Building, 110 East Main Street in Cumming.

If approved, the General Fund budget will be balanced at $164,174,088 and will include a 4 percent increase in the cost of living allowance (COLA) for all county employees as well as an increase in the budget allowance for employees 401(k) match.

The largest expenditure is the $57,557,045 budget for the Sheriff’s Office, a 6.7 percent increase over 2021. The fire department will operate on a budget of $32,426,794.

The budget anticipates the addition of seven new full-time employees.

Commissioners are expected to approve a proclamation declaring Nov. 4, 2021 as the Festival of Diwali in Forsyth County. Diwali is a festival of lights and one of the main festivals celebrated by Hindus.

There will also be a presentation of Milestone Service Awards to various County employees for having reached twenty-five or more years of service.

Public hearings on the agenda include:

County Commissioners hold second public hearing on 2022 proposed budget of $164 million

FORSYTH COUNTY, Ga. — Chief Financial Officer Marcus Turk presented the proposed 2022 budget at a second public hearing before the Board of Commissioners. Thursday (July 9). Commissioners can adopt the budget following the third public hearing set for July 22.

The overall millage rate has tentatively been set at 7.896. The overall rate is comprised of the Maintenance and Operation rate (4.791), Fire Fund (2.175) and Bonds (9.30).

The General Fund revenue is projected to be $163,966,724 with expenditures expected to total $158,772,324 which will leave approximately $5.2 million to be added to the contingency fund. The tax digest is expected to increase by about 4.54 from one year ago.

The Forsyth County School System Maintenance and Operation millage rate has been tentatively set at 17.300 and School Bonds millage rate at 2.418.

No one spoke in favor of or in opposition to the proposed budget.

Forsyth County Board of Commissioners to discuss land bank at Thursday meeting

FORSYTH COUNTY, Ga. — The Board of Commissioners will discuss funding for the Forsyth County/City of Cumming Land Bank Authority and of retaining counsel for guidance and related matters when it meets Thursday July 8 at 5 p.m. in the County Administration Building, 110 East Main Street in Cumming.

The purpose of the land bank is to focus on conversion of vacant, abandoned and tax-delinquent properties to productive use.

One example of such a property is the Greenleaf development near the Forsyth, Dawson County line started some 15 years ago that was abandoned after it became the subject of builder-based fraud. The 60 lots were too small to permit septic tanks, there was no sewer and the county did not approve the streets.

The lots were overgrown with weeds and the few houses that were built were vandalized subject to burglary, loitering, abandoned vehicles. The county had the homes demolished in 2015.u

County officials hope the land bank will help the community turn an eyesore into a more productive use.

The Board will also discuss acceptance of  payment of policy limits of $25,000 for damage sustained to Unit # 124 with authorization for the Risk and Safety Manager to execute the Property Damage Release with Michelle Desjardins and GEICO Indemnity Company.

There will also be a discussion regarding the renewal of an annual Insurance Coverage Agreement with ACCG-IRMA in the amount of $931,872.
