New audit could mean some county employee dependents not eligible for health care coverage

FORSYTH COUNTY, Ga. — The Forsyth County Board of Commissioners approved an audit agreement with Impact Interactive Tuesday that could mean up to 10 percent of county employee dependents are no longer eligible for the County’s health insurance plan.

Employee Services Director Charity Clark told the Board that as many as 10 percent of dependents who are already enrolled may be ineligible.

Impact Interactive will be paid $17,988 to conduct an enrollment and verification audit for 2023 to determine which dependents do not meet requirements of the plan. Clark said the audit could result in a savings of hundreds of thousands of dollars to County taxpayers.

Clark also said the company guarantees the audit will save the County more money than the plan costs. Commissioner John asked if Aetna does not already provide the service.

County Manager Kevin Tanner said because the County is self-insured, it is responsible for its plan, not Aetna.

Public safety workers receive salary increase

FORSYTH COUNTY, Ga. — While many Democrat-run counties are still working to de-fund law enforcement and other public safety employees, Forsyth County has decided to in a different direction, awarding a salary increase of up to 16 percent.

With the Board of Commissioners’ passing of the FY 2023 budget on Aug. 18, certified public safety employees of the County’s E911 Department, Fire Department and Sheriff’s Office will receive a 4
percent Cost of Living Adjustment (COLA) beginning Sept. 26, 2022. These employees are

also eligible to receive a salary increase of up to 12 percent beginning Jan. 1, 2023.

“Forsyth County is one the safest places to live and work in Georgia,” said County Manager Kevin Tanner. “This is only possible because of the dedication of our law enforcement, fire and 911 personnel.
The Forsyth County Board of Commissioners values these employees and continues to do everything necessary to ensure that we can offer one of the most competitive pay and benefit packages in the
area.”

The salary increases are based on market salary information used to ensure new salary rates are competitive in the metro Atlanta market. With this increase, Forsyth County will provide one of the highest salaries in the state for public safety.

The County’s recruitment efforts go beyond public safety with other recent Board decisions to attract and retain talent County-wide.

“Forsyth County took another substantial step forward for all County employees by creating a student loan payback program, a tuition reimbursement program and increasing the County’s 401(k) retirement contribution to a maximum of 15 percent,” said Tanner.

Along with these initiatives, the adopted 2023 Budget allows for Forsyth County to conduct a comprehensive Market Salary Study which will include all personnel, including civilian employees who
currently work for a public safety department.

Forsyth County will apply for $19.1 million grant for drinking water projects

FORSYTH COUNTY, Ga. — The Board of Commissioners agreed to apply for the Coronavirus State Fiscal Recovery Fund in the not-to-exceed amount of $19,100,000 during Tuesday’s work session. The County will provide a match in the not-to-exceed amount of $3,820,000.

The funding is made available through a Grant provided by the Governor’s Office of Planning and Budget for Drinking Water Projects to Support Increased Population.

The Board also approved

  • The addition of a Health and Wellness Coordinator position Grade 15 for the remainder of 2022 at a cost not to exceed $30,000, including salary, benefits and non-capitol items;

County approves sewer rate to be charged to the City of Cumming

FORSYTH COUNTY, Ga. — The Board of Commissioners set a sewer capacity rate of $33 a gallon plus a 10 percent surcharge for developments in the County’s service area that flow to the City of Cumming’s plant for treatment during Tuesday’s work session.

County Water and Sewer Director Barry Lucas, said, “Staff recommendation is to set the rate at the prevailing rate charged by the City to the County plus a 10 percent surcharge.”

Lucas noted that the County has other areas that flow to the City for treatment and he recommended setting a consistent rate regardless of the area.

The Board also approved:

  • The Sheriff’s request to apply to the Criminal Justice Coordinating Council FY 23 Juvenile Prevention and
    Intervention Grant Program in the amount of $50,000 with no match required.;
  • Staff to proceed with advertisement and the
    Public Hearing process regarding a proposed abandonment of a portion of Sandy Court as requested by CRC 100, LLC, a Georgia Limited liability company, to
    facilitate commercial development on Sandy Court, south of the northern intersection of Sandy Court and Crossroads Road;
  • A Sludge Disposal Agreement with GFL Environmental at a
    rate of $74.95 per ton;

Voters want Dominion voting machines replaced by paper ballots

FORSYTH COUNTY, Ga. –For the second time in the last two weeks, Forsyth County residents called on the Board of Commissioners to remove the Dominion voting machines used here and in many, if not all, Georgia counties and replace them with paper ballots.. 

Speaking during the Public Comments portion of the Board of Commissioners meeting Thursday, Jeff Tormey  said, “Voters have significant concerns about the Dominion voting machines. They are frustrated because they believe their votes do not count.”

He added, “From my perspective, you intend on doing nothing. Nothing only makes the lack of trust  in our system worse. This voting system has vulnerabilities that can be exploited by bad actors.”

He cited an election in DeKalb County earlier this year where, following a headcount, the results were reversed. “The loser was the winner and the winner was the loser. This is a massive problem.”

Frank Schneider has expressed concerns in the past about the voting machines, so he asked, “What have you done?” He then asked, “What can we do to help you?” He recommended County officials conduct a hand count of votes immediately following the close of voting but before certification of the votes. “I do believe that your constituents do not trust the voting process in Forsyth County.”

Before the end of the meeting, County Attorney Ken Jarrard said he would provide the Board with an analysis of what power they possess relative to replacing the machines. He also noted, “This is not the only jurisdiction where requests of that kind have been made.” 

Government buildings in Cumming will light up purple on Aug. 31

FORSYTH COUNTY, Ga. — On Aug. 31, the government buildings in Cumming will join buildings and landmarks across the nation in lighting up purple in recognition of Overdose Awareness Day.

According to the Georgia Department of Public Health, all drug overdose deaths in Georgia increased by 55.9 percent from 2019 to 2021 with Fentanyl-related overdose deaths increasing in Georgia by 106.2% between May 1, 2020 and April 30, 2021.

During their Aug. 18 meeting, the Forsyth County Board of Commissioners proclaimed Wednesday, Aug. 31, as Overdose Awareness Day in Forsyth County and urged all residents to learn more about prescription drug overdose prevention as well as how to aid and support those that are affected by it.

On deck: Another major industrial development in north Forsyth

FORSYTH COUNTY, Ga. — For the second time in two weeks, the Board of Commissioners is expected to approve a county-initiated rezoning application for a major industrial development when it meets Thursday at 5 p.m.

The application requests rezoning from agricultural (A1), highway business (HB) and commercial business district CBD to restricted industrial district (M1) for more than 800,000 square feet of building space on 74.328 acres at GA. Hwy. 400 and Bottoms Road.

The application also requests a conditional use permit (CUP) for the following uses:

  • Breweries and distilleries
  • Cold storage plants
  • Food processing plants

On Aug. 4, the Board approved the application for construction of an industrial park of more than 600,000 square feet off Settingdown, Martin and Church roads.

Both facilities are being built in the north end of the county where sewer infrastructure is reserved for non-residential development in the north end of the county. That investment is expected to pay dividends for many years.

Commissioners review proposed amendments to county sign ordinance

FORSYTH COUNTY, Ga. — As authorized by the Board of Commissioners, the Planning and Community Development Department drafted a list of amendments to the Forsyth County Sign Ordinance regarding electronic message boards (EMB) for the Board’s consideration.

Planning Director Michael Chapman presented the proposed amendments at Thursday’s meeting.

EMBs must have a minimum of 100 feet of frontage along an urban divided roadway with a median.

The current ordinance allows EMBs that have a principle use that is either a religious facility, college or university private or parochial school, hospital, military or veteran organization. The proposed change would add assembly hall, meeting hall, auditorium, art gallery, museum, nonprofit club or lodge theater or amphitheater.

In commercial or office districts, currently, EMBs are permitted only for fueling station monument signs where the changeable copy area shall not exceed 46square feet. Under a new proposal, they would be permitted where principle use is either a religious facility, college or university private or parochial school, hospital, military or veteran organization. The proposed change would add assembly hall, meeting hall, auditorium, art gallery, museum, nonprofit club or lodge theater or amphitheater.

In the Castleberry/Bethelview Crossroads Overlay District, EMBs are prohibited.

In the Buford Highway Overlay District, free standing signs where the building size is not over 10,000 square feet are limited to a height of 6′ feet with one sign per property. Where the building size is 10,001 to 50,000 square feet a height of 8 feet is permitted. Where the building size 50,001 to 100,000 a sign height of 10 feet is permitted. Where the building size is 100,000 square or greater, sign height of 12 feet is permitted and two signs per road frontage is permitted.

EMBs or changeable copy signs are currently permitted at fueling stations (one per road frontage). The recommendation would also allow EMB or changeable copy signs where the principle use is either a religious facility, college or university private or parochial school, hospital, military or veteran organization

Commissioner Todd Levent suggested that some county signs may be out of compliance, County Manager Kevin Tanner responded “there are a lot of signs not in compliance.” Commissioner Laura Semanson agreed. “More than you may think,” she said.

The amendments will be the subject of a future public hearing.

County withdraws from LOST talks, will enter mediation process

FORSYTH COUNTY, Ga. — The Board of Commissioners abruptly ended formal negotiations with the City of Cumming Tuesday regarding continuation of the local option sales tax (LOST).

Although discussions had produced at least the framework of an an intergovernmental agreement (IGA), commissioners voted 5-0 to short circuit the negotiation process and go directly to mediation or arbitration.

The Board gave no reason for its decision. Although some commissioners have complained that Commissioner Laura Semanson, who is negotiating for the County, has kept them in the dark regarding the discussions.

In making the motion to go into mediation, Cindy Jones Mills said, “I believe it would be appropriate for us to enter into mediation so we can all be part of the discussions.”

The two sides had a deadline of Sept. 1 to reach an agreement and until Dec. 30 to produce a new certificate to send to the Department of Revenue.

 

 

City/County local option sales tax negotiations on BOC agenda

FORSYTH COUNTY, Ga. — County Commissioners have a full slate of 23 agenda items to consider when they meet in a work session today (Aug. 9) in the Administration Building, 110 East Main Street in Cumming.

Commissioners will discuss renewal of the Local Option Sales Tax (LOST) and the negotiation of the intergovernmental agreement with the City of Cumming.

The two governments must come to an agreement on the distribution of funds generated by the local option sales tax (LOST) by Sept. 1 or they will have to submit to non-binding agreement or mediation. Commissioner Laura Semanson has represented the county in those negotiations.

The Board will also consider a budget second amendment to the services agreement with Common Courtesy, Inc. that will more than double the cost of the original not-to-exceed contract from $140,000.00 to $290,000.00.

Additional items to be discussed include:

  • Authorization for the Sheriff’s Office to accept the award of
    the BJA FY 22 Byrne Discretionary Community Project Funding in the amount of $235,000 with no required match;
  • Approval of a Memorandum of Understanding for contractors
    to provide treatment services, substance screening, and 4th Amendment waiver;
  • Approval of a Sub-Grant Agreement with the Georgia
    Department of Transportation (GDOT) for the award of FTA 5311 Operating Grant Funds in the amount of $170,671.00 with a 50/50 required match;
  • Authorization to apply for the State of Georgia FY2023 Local
    Maintenance & Improvement Grant (LMIG) for an amount not to exceed $2,739,311.67 with a required match of up to $1,173,990.60;
  • Approval to award Bid 22-47-1514 to provide all labor,
    materials, and equipment for the renovation of the Central Park Recreation Center to Cooper & Company General Contractors, Inc. in the amount of $7,400,000;
  • Approval of the purchase of 518 Stream Buffer Mitigation
    Credits in the amount of $95,830.00 from Three Creeks Mitigation Bank, LLC for the McGinnis Ferry Widening Project (PEW08 – widening portion only);
  • Acceptance of the FY22 BJA Byrne Discretionary
    Community Project Grant in the amount of $90,000 with no required match;
  • Authorization to implement a 4% Cost of Living Adjustment
    (COLA) for FY 2022, as of September 26, 2022, for specific positions identified to receive a Market Salary Adjustment in FY 2023 in the following Departments: Sheriff’s
    Office; Fire; and, E-911 in the not to exceed amount of $827,750.00;
  • Authorization to amend Revenues and Expenses on behalf
    of the Department of Parks and Recreation in the amount of $51,000;
    (11) A Board generated rezoning for ZA3952, Yousef Emtairah. In accordance with UDC 8-5.5(I), if an application for a
    Land Disturbance Permit has not been submitted within 18 months of zoning approval, the Board may consider rezoning to a constitutional zoning designation;
  • Modification(s) to the Forsyth County Sign Ordinance and Unified Development Code regarding Electronic Message Boards and Window Signs for certain commercial purposes – Planning;
  • Amendments to the Unified Development Code related to Variances to Parking Surfacing within Chapters 8 and 17;
  • Correction, realignment, modification, and clarification to the boundaries and site plan of the Coal Mountain Town Center;
  • Amendments to the Unified
    Development Code related to the Coal Mountain Overlay within Chapter 21, to include amendments that would incorporate the Coal Mountain Town Center Design

  • A County-Initiated Amendment to Zoning Conditions for ZA2548 tax map/parcel 237-002;

Miracle League ball field at Lanierland Park named to honor Col. Carroll Edge

FORSYTH COUNTY, Ga. — The new Miracle League ball field at Lanierland Park will bear the name Col. Carroll and Judy Edge Field.

Commissioners recognized Col. Edge for his tireless advocacy for the Miracle League of Cumming/Forsyth County by naming the field in his honor at the Aug. 4 Board of Commissioners.

Col. Field has been supporting the Miracle League of Cumming/Forsyth County since its inception in 2005 helping to grow the league and provide a warm and welcoming experience for the participants and their families.

“Col. Edge’s deep love for the league participants and his dedication to ensuring each of them has a wonderful experience brings smiles to many in the community,” said District 5 Commissioner Laura Semanson. “He can be seen opening the gates at 7 a.m. on gamedays and frequently staying until all participants and their families have left the ballpark.”

The Col. Carroll & Judy Edge Field Miracle League Field will be one of many new amenities coming to Lanierland Park (6115 Jot-Em-Down Rd.) upon the completion of an expansive project that also includes:

– Eight tennis courts

– Four pickleball courts

– Four baseball/softball fields

– All-inclusive playground

– Hard and soft surface trails

– Football/lacrosse fieldhouse

– Additional parking

New amenities will be unveiled at Eagle’s Beak Park ribbon cutting Aug. 16

FORSYTH COUNTY, Ga. — The facelift at Eagles Beak Park is complete and County Commissioners and the Parks and Recreation Department will hold a ribbon cutting Tuesday (Aug. 16) at 3 pm. to celebrate the occasion.

The new amenities, including an inclusive playground, a 1.25-mile paved walking trail,  and historical signage marking the Trail of Tears will be unveiled along a scenic river overlooked by a picnic pavillion.

“Eagles Beak Park combines history and beauty along the Etowah River, and we are very excited to provide access to another great natural resource in Forsyth County,” said Parks & Recreation Director Jim Pryor.

The additions to the park have been made possible through a Georgia Department of Natural Resources grant in the amount of $2.25 million. Eagle’s Beak Park is one of 14 statewide recipients of the inaugural Georgia Outdoor Stewardship Program (GOSP) grant. The County’s contribution to the grant is $769,000, which is paid through the County’s Landfill Host Fee fund.

“To be selected in the first year of this new grant program is a testament to our great staff who worked hard on the application,” said Forsyth County Board of Commissioners District 4 Commissioner Cindy Jones Mills,

“When I first heard that this opportunity was available, I thought about Eagle’s Beak, located on the Trail of Tears. I knew this would be a perfect place to honor the rich Native American history of the area and have a park where parents can teach their children about it. The park will also be the northwest starting point for the North Subarea Trail System which will run east across the County to connect with Lake Lanier once completed.”

Construction was provided by the Bayne Development Group, and the architect for the new amenities was Hayes-James & Associates.

Eagle’s Beak Park, located in northwest Forsyth County, also has amenities such as a canoe/kayak launch on the Etowah River, a 1.3-mile nature trail and restroom facilities.

Board of Registrations expected to issue the call for TSPLOST today

FORSYTH COUNTY, Ga. — The Forsyth County Board of Registrations and Elections will meet in a called meeting today at 11 am when it is expected to issue a call for a Transportation Special Purpose Local Option Sales Tax to be placed on the Nov. ballot.

County Attorney requests the Board of Commissioners amend the language in the SPLOST resolution approved last week.

The Board of Commissioners authorized the SPLOST in a resolution at the July 26 meeting, but the language was amended at last night’s Board of Commissioners meeting at the request of County Attorney Ken Jarrard.

The language initially included a list of projects that could be funded by SPLOST. Jarrard said the list of projects should not have been included on the ballot. The Board unanimously approved the amendment to delete the projects.

Commissioner Todd Levent called for the project list to be discussed in a work session later this month. “It is very important since its not on the ballot that we get a legitimate project list so the citizens know what we are going to work on. ” His motion was unanimously approved.
