BOC must decide on 310-unit residential, and commercial development Thursday

FORSYTH COUNTY, Ga. – The Board of Commissioners is expected to render a decision on a massive commercial/residential development with 310 attached residential units and 39,100 square feet of commercial buildings when it meets Thursday at 5 pm in the County Administration Building, 110 East Main Street in Cumming. If approved, the WP South Acquisitions, LLC development will occupy 51.72 acres with a density of six units per acre and will include 172 parking spaces.

Also, the Board will consider Georgia Sports Arena’s request to rezone from Neighborhood Shopping District (NS), Single Family Residential District (R1) and Commercial Business District (CBD) to Commercial Business District (CBD) on 13.92 acres located at the intersection of Atlanta Highway and Valley Circle Road for an office, retail trade establishment, a 6,000 sq. ft. restaurant and a 55,600 sq. ft. indoor commercial recreational facility with a Conditional Use Permit (CUP) for outdoor commercial athletic fields with 315 parking spaces with the following variance to: 1.) Reduce the exterior buffer adjacent to outlots 1-4 from 40 ft. to 0 ft. (UDC 16-4.6(C).  – Parcels 130-049, 130-050, 130-052, and 130-068 – District 3 – Director, Department of Planning and Community Development

A proposed settlement agreement with Greenspace Properties LLC, Parker Chandler Homes LLC, Comstock Holding Companies, Inc., Thomas Bagwell, Branch Banking and Trust Company regarding an action pending in Forsyth County Superior Court is also on the agenda. The proposed settlement would impose zoning and land use-based entitlements, variances, restrictions, and other obligations on the parties and on 37 +/- acres at tax parcel 236-003.

The Board will hold the following public hearings:

  • The request for an Alcohol License to sell malt beverages (beer), wine, and distilled spirits by the package on the premises for Maharshi 3010 LLC dba Gary’s Wine & More located at 3010 River Club Drive – Named Licensee is Hiral Patel;
  • The revocation or modification of conditions of existing CUP CP190025 in accordance with UDC Section 8-5.5(i);
  • The County-Initiated request for approval of a Sketch Plat to build a 131,805 sq. ft. office/warehouse with 149 parking spaces on 13.307 acres currently zoned Restricted Industrial District (M1) – Parcels 017-199 and 017-200 – SP210002;
  • The County-Initiated variance request to: 1.) Reduce the zoning buffer along the northern property boundary from 60 ft. to 40 ft. (UDC Table 14.2); and, 2.) Reduce the zoning setback adjacent to parcel 017-046 from 75 ft. to 55 ft. (UDC Table 14.2) – Parcels 017-199 and 017-200 – VA210045;
  • The 2020 Impact Fee Capital Improvements Element Update and Community Work Program Addendum with Board adoption of a Resolution to submit to the Atlanta Regional Commission (ARC);
  • Amendments to Chapter 10 related to Accessory Structures (including pools) and Accessory Buildings within the Unified Development Code of Forsyth County; Under Old Business, the Board will consider:
  • Providing direction regarding Sketch Plat approval for RUS-AL (USA), Inc. and Variances to the UDC Section 14-1.3 and Table 14.2 – Parcel 041-099 – SP190002;
  • RUS-AL (USA), Inc., CP190014, to operate an open storage yard with 133 parking spaces associated with existing buildings totaling 18,000 sq. ft. with 26 parking spaces on 6.680 acres currently zoned Restricted Industrial District (M1) with variances to: 1.) Reduce the zoning buffer along the eastern property boundary from 60 ft. to 0 ft. (UDC, Table 14.2); 2.) Reduce the front setback from 50 ft. to 35 ft. abutting Union Hill Road right-of-way adjacent to the existing structure only (UDC, Table 14.2); and, 3.) Reduce the zoning setback from 75 ft. to 65 ft. along the eastern property boundary adjacent to the existing structure only (UDC, Table 14.2);
  • A request for an Amendment of Zoning Conditions on ZA3079 (Ackerman & Company) by Rockhaven Homes, LLC – Parcels 002-008 and 003-003 – AZ210028;
  • An Alternate Design for Jones Bridge Road Associates, LLC – Parcel 200-235 – AD210003.

Under New Business, the Board will consider the following conditional use permits:

  • RJJ Development LLC – ZA4011 – to rezone from Single Family Residential District (RES3), Neighborhood Shopping District (NS) and Agricultural District (A1) to Single Family Residential District (RES3) on 20.481 acres for 27 residential lots with a density of 1.32 units per acre – Parcel 009-188;
  • Epic Homes, LLC – ZA4004 request to rezone from Agricultural District (A1) and Single Family Community Residential District (CR1) to Single Family Residential District (RES3) on 11.339 acres for 19 residential lots with a density of 1.68 units per acre with the following variance to: 1.) Reduce the exterior buffer abutting Caney Road from 40 ft. to 30 ft. (UDC Table 11.2(b)) – Parcel 089-470;
  • JKN Ventures, LLC – CP210009 request to build a 5,390 sq. ft. minor automobile service establishment with 18 parking spaces on 2.17 acres currently zoned Commercial Business District (CBD) with the following variance to: 1.) Reduce the landscape strip along the side lot line from 10 ft. to 0 ft. (UDC 12-10.15)(UDC 21-6.5(A)(2)) – Parcel 018-210;
  • Jonathan Gonzalez – ZA4007 request to rezone from Agricultural District (A1) and Single Family Residential District (R1) to Commercial Business District (CBD) with a Conditional Use Permit (CUP) for an open air business on 2 acres associated with an existing 1,036 sq. ft. building with 8 parking spaces with the following variances to: 1.) Reduce the front setback from 40 ft. to 24 ft. (UDC Table 12.2); 2.) Reduce the front landscape strip from 20 ft. to 10 ft. (UDC 21-6.5(A)(1)); and, 3.) Reduce the required number of parking spaces from 75 to 8 (UDC Table 17.1) – Parcel 017-055;
  • Board consideration and approval of the Consent Order and Judgment for Civil Action File No. 19CV-2206-2 in the amount of $113,000.00 in connection with Parcel 9 of the SR 369 at Ga 400 Project (Owners: Bobby Joe Wofford, Jr. and Benjamin Carl Wofford) – County Attorney

 

 

Planning Commission will hear a request to build 310 attached apartments on Settingdown Road

FORSYTH COUNTY, Ga. — The Forsyth County Planning Commission will consider a request by WP South Acquisitions, to rezone property at 4715 and 4735 Settingdown Circle to build 310 attached residential units and commercial buildings totaling 39,000 square feet when it meets Tuesday (Apr. 27) at 6:30 p.m. in the County Administration Building.

Applicant is asking to rezone 51.7 acres from Multi-Family Residential Restricted District and Commercial Business District to Master Planned District with a density of (MPD) with a density of 6 units per acre and a variance to increase the percentage of total residential units for apartments from 20 percent to 100 percent.

Public hearings scheduled Tuesday include:

  • UDC modifications related to a lot of record;
  • UDC modifications related to manufactured/mobile homes;
  • A request by Paul Marks to operate an open storage yard with 178 parking spaces with a 740 sq. foot accessory office with four parking spaces on 6.750 acres located at 5755 and 5765 Namon Wallace Road. Applicant is also seeking a variance to eliminate the 5,000 ft. sewer distance requirement to facilitate the use of an on-site septic disposal system;
  • A request by Qing Zhang to rezone from Single Family Residential District (R1) to Commercial Business District (CBD) on 1.47 acres located at 4625 Atlanta Highway in Alpharetta with a Conditional Use Permit (CUP) for an open air business associated with existing buildings totaling 2,900 sq. ft. and 13 parking spaces.

The Planning Commission makes recommendations to the Board of Commissioners which has the final decision on any of these requests.

FORSYTH COUNTY, Ga. – WP South Acquisitions plan to build 310 apartments and 39,100 square feet of office/space on Settingdown Circle is back on the Planning Commission agenda when it meets Tuesday (Mar. 23) in the County Administration Building at 6:30 p.m.

The developer is requesting that 51.7 acres at 4715 and 4735 Settingdown Circle, west of Ga. 400 be rezoned from Commercial Business District to Master Planned District. The issue was on the Feb.25 meeting, but was postponed until Mar. 23
