County hosts ribbon cutting at Sawnee Mountain Park

FORSYTH COUNTY, Ga. – A long-awaited ribbon cutting ceremony took place Wednesday at Sawnee Mountain Park, 3995 Watson Road.

The ceremony showcased Improvements to the park  to include baseball/softball complex improvements, a new inclusive playground, refurbished tennis courts and updates to the concession stand and restrooms.

The parking lot was also seal coated and restriped. A new pavilion, also a part of the renovation project, is expected to be installed later.

District 1 Commissioner Molly Cooper said, “This is a growing area here in west Forsyth, so providing an update to this already great park made perfect sense to give even more recreation opportunities.”

Most amenities at the park closed for renovations on May 10 and are now open to the public.

County staff preparing DRI review for Coal Mountain Town Center

FORSYTH COUNTY, Ga. – A major project that has been talked about for at least four years took a concrete step forward Tuesday when the Board of Commissioners directed staff to begin a development of  regional impact (DRI) review for the Coal Mountain Town Center overlay.

A DRI is a large-scale development or one that is likely to impact neighboring communities. DRIs are then subject to review by the Atlanta Regional Commission.

The plan presented by representatives of Toll Brothers Tuesday will be approximately 145 acres located just west of Ga. Highway 400, near the intersection of Browns Bridge Road and Dahlonega Highway.

The development will consist of 158,000 square-feet of retail, 108,000 square-feet of office space, 300 multi-family units, 130 townhomes, 278 single-family units and 201 senior family units.

The Board also approved:

  • The award of 21-157-2410 for Fire Hydrant Field Testing for calendar year 2022 to American Flow Services in the not to exceed amount of $145,000;
  • The award of Bid 21-180-3340 for the Hammonds Crossing 16-inch Water Main Project for the Department of Water and Sewer to Unity Construction Co. in the amount of $2,040,255.70;
  • The award of Bid 21-191-1620 for Landscaping Services and Detention Pond Clearing at various locations for calendar year 2022 for the Department of Public Facilities to REMS Property Management in the not to exceed amount of $166,530;
  • The award of Bid 21-198-5211 for Resurfacing and Restriping at Shady Grove Campground for the Department of Parks and Recreation to The Surface Masters, Inc. in the amount of $129,250;
  • The award of RFP 21-171-1512 for Pre-Employment Physicals and Drug Testing on an as-needed basis for calendar year 2022 for the Department of Personnel Services to Peachtree Immediate Care in the not to exceed amount of $26,000;
  • The award of RFP 21-173-1550 for DOT and FTA Drug Testing on an as-needed basis for calendar year 2022 for the Department of Risk Management to Peachtree Immediate Care in the not to exceed amount of $3,500;
  • The award of Bid 21-125-3190 to provide all labor, materials, and equipment for Old Atlanta Road Phases 4 and 5 to G. P.’S Enterprises Inc. in the amount of $51,400,000;
  • The acceptance of payment in the amount of $28,075.58 for damage sustained to Sheriff’s Office Unit # 553 with authorization for the Risk and Safety Manager to execute the Property Damage Release with Hanover Insurance Group;
  • The approval of the Sawnee Mountain Foundation Agreement for Grant Funds in the amount of $125,000;
  • Authorization for the Sheriff’s Office to accept the award of the Criminal Justice Coordinating Council BJA FY2020 Coronavirus Emergency Supplemental Funding Program (CESF) in the amount of $14,359.00 with no required match;

  • A resolution to condemn property interests in Tax Parcel 113-425 (Leslie Jane Loughmiller) of the McGinnis Ferry Road Widening Project with authorization for the Chair to execute document in furtherance of same; estimated just and adequate compensation: $4,100.00;
  • A resolution to condemn property interests in Tax Parcel 114-064 (Brian and Dianna Brooks) of the McGinnis Ferry Road Widening Project with authorization for the Chair to execute document in furtherance of same; estimated just and adequate compensation: $12,900.00;
  • (27) Board consideration of a Resolution to condemn property interests in Tax Parcel 114-145 (Dustin Clevenger) of the McGinnis Ferry Road Widening Project.

 

 

Forsyth County agrees to settle case pending in Superior Court

FORSYTH COUNTY, Ga. – The Board of Commissioners Thursday approved a settlement in a civil action pending in Forsyth County Superior Court that paves the way for the construction of a residential subdivision of 130 units on South Clement Drive near Hwy. 141.

The litigation entitled Alex C. Kliros vs. Tom Brown et. Seq. was originally presented to Forsyth County for a Res 3 designation of 189 units on 90.37 acres. The agreement calls for a change to Res 2 designation and a reduction in the number of units to a maximum of 130. Other compromises reached include the movement of the amenity package from South Clement to the interior of the development, the application of Forsyth County architectural standards, donation to the adjacent Creekstone for the construction of a subdivision monument and covenants that provide for the maintenance of the South Clement roundabout.

Following the reading of the proposed agreement by County Attorney Ken Jarrard, the Board held a public hearing and approved the settlement by a vote of 4-0 with Commissioner Molly Cooper being absent.

In other public hearings, the Board:

  • Held the first of two public hearing on amendments to the alcohol ordinance regarding delivery of alcohol, package alcohol, mixed drinks to go, manufacturing and production and sales limits and renewal of conditional licenses;
  • Approved a request by Nelson and Jennifer Lafayette (The Peachtree Development Group) for an amendment of zoning conditions and variance of UDC table 11.2 to reduce a rear setback;
  • Approved a request by Doman Realty, Inc. to amend zoning conditions on ZA 3998 to change from single-story 3,000 square foot homes to 2,600 single-story homes;
  • Postponed a request by Jeffrey and Dawn Johnson for a reduction in a rear setback from 20 feet to 7.5 feet;
  • Approved a variance by Vickery Land Co., LLC (Tracey L. Varrone) of a zoning condition to include a private school special education facility;
  • Approved an amendment to the UDC relating to timber harvesting;
  • Postponed a public hearing on proposed amendments to Chapter 20b related to Specialty Districts within the Unified Development Code.

Under Old Business, the Board:

  • Approved RJJ Development request to rezone 20.3 acres from NS, A1 and Res 3 to Res 1 for 27 lots on 20.43 acres northwest of Heardsville Road;
  • Approved JKN Ventures, LLC  request to build a 5,390 sq. ft. minor automobile service establishment with 18 parking spaces on 2.17 acres currently zoned Commercial Business District;
  • Approved Jonathan Gonzalez request for a zoning amendment to rezone from Agricultural District (A1) and Single Family Residential District (R1) to Commercial Business District (CBD) with a Conditional Use Permit (CUP) for an open air business on 2 acres associated with an existing 1,036 sq. ft. building with 8 parking spaces with the following variances to: 1.) Reduce the front setback from 40 ft. to 24 ft. (UDC Table 12.2); 2.) Reduce the front landscape strip from 20 ft. to 10 ft. (UDC 21-6.5(A)(1)); and, 3.) Reduce the required number of parking spaces from 75 to 8 (UDC Table 17.1) – Parcel 017-055 – District 3 – Director, Department of Planning and Community Development;
  • Approved Georgia Sports Arena, LLC request to rezone from Neighborhood Shopping District (NS), Single Family Residential District (R1) and Commercial Business District (CBD) to Commercial Business District (CBD) on 13.92 acres for an office, retail trade establishment, a 6,000 sq. ft. restaurant and a 55,600 sq. ft. indoor commercial recreational facility with a Conditional Use Permit (CUP) for outdoor commercial athletic fields with 315 parking spaces with the following variance to: 1.) Reduce the exterior buffer adjacent to outlots 1-4 from 40 ft. to 0 ft. (UDC 16-4.6(C)) – Parcels 130-049, 130-050, 130-052, and 130-068.

Under New Business, the Board denied a request by Apparao Chithaluri for a Public Hearing regarding an appeal of the Zoning Board of Appeals’ (ZBA) decision to deny a variance on VA210047 (Apparao Chithaluri).

Commissioner Molly Cooper

FORSYTH COUNTY, Ga.  – Forsyth County District 1 Commissioner and Vice-Chairwoman Molly Cooper was recently diagnosed with pancreatic cancer following a routine doctor visit for an illness.

“Commissioner Cooper is doing well and has a positive prognosis from her medical team,” said County Manager Kevin Tanner. “She is still actively involved in the day-to-day operations of her district and her constituents’ concerns. As she begins treatment, we hope that residents will join me, as well as County staff and elected officials, in sending prayers and good wishes to Commissioner Cooper for her recovery.”

Commissioner Molly Cooper was elected in 2018 to serve as the District 1 commissioner for the 2019-2022 term. Commissioner Cooper was elected by the Board of Commissioners to serve as secretary in 2020, and as vice-chairwoman in 2021.

Commissioner Cooper has been a resident of Forsyth County for the past 28 years. During that time, she has served as President of the Republican Women of Forsyth County, President of Civitan and was the first the vice-chair of Forsyth County GOP. Commissioner Cooper has owned and operated a local business for over 16 years.

FORSYTH COUNTY, Ga. – The normally uneventful process of appointing members to a committee quickly erupted into an embarrassing 30 minutes of angry shouting, accusations of “manipulation” and “dirty” tactics at the Board of Commissioners meeting Tuesday.

Furious about the way the nominating process for members of the Development Authority was conducted, Commissioner Laura Semanson said, “This is not the way it was supposed to go. If that is the way we’re going to do this, count me as a no vote on all nominees. This is something that was pulled off at the last minute and I am not okay with it.” She argued that each commissioner was to have a nominee and that each one would receive an up or down vote

Chairwoman Cindy Mills reminded her that the process the Board agreed to provided that the first two nominees to receive a simple majority vote would receive the appointment.

Semanson and Commissioner Molly Cooper proposed writing the five nominees’ names on a piece of paper then ranking them to determine the nominations but the county attorney said the rules the Board adopted do not provide for that.

An irate Semanson then claimed the process had been “manipulated by someone with an agenda.” Mills answered, “If it was manipulated, it wasn’t by me. To my knowledge no one manipulated it.”

Clayton Rhodes, Commissioner Todd Levent’s nominee, and Grant Schmelk, Cooper’s nominee, eventually received the at-large appointments by a majority vote.

Semanson then sarcastically told Levent, “Good you got your way, but it was dirty.”

Commissioner Alfred John, who just came onto the Board in January, tried to defuse the situation saying, “It is not becoming of us to keep going on and on. It’s decided. Let’s move on.”

·        The purchase of replacement membranes for the Manor Water Reclamation Facility from Suez Water Technologies in the amount of $234,446.00;

County commissioners file objection to City annexation along Antioch Road

FORSYTH COUNTY, Ga. – The Board of Commissioners voted unanimously Tuesday to file an objection to the City’s proposed annexation of 21.259 acres along Antioch Road for use as a construction operation. The annexation would require a change of zoning from Residential 1 to Heavy Business.

The proposed use anticipates redevelopment of existing structures on the site, construction of an office, a shop to the rear and storage yard for heavy equipment. County Attorney Ken Jarrard is expected to deliver the county’s objection to city officials today.

Commissioner Molly Cooper noted that Antioch Road is mostly residential and added, “this is the wrong product for the wrong place. That heavy equipment is going to tear that road up like nobody’s business and we all know it.”

The Board also approved a consent order in connection with the McGinnis Ferry Road Interchange project that requires the county to pay $214,700 above the $17,000 already paid into the court registry.

In other business, commissioners:

  • Awarded RFP 20-146-1620 for Electronic Message Boards, Directories, Kiosk Design, and Installation for the Department of Public Facilities to Frontier Vision Technologies, dba Evogence in the amount of $40,302;
  • Awarded Bid 20-155-2920 to purchase Personal Protective Equipment (PPE) items as needed for Forsyth County departments and offices to My Medical, Norfleet Distributors, Avenue Medical Equipment, Inc., Office Depot, and LT Printing & Promotions;
  • Approved a new three-year agreement with Microsoft Enterprise in the amount of $576,409.19 annually;
  • Approved a sole-source purchase for four Model 4 Wireless Earthlift Control lifts through Steril-Koni for the Department of Fleet Maintenance in the amount of $49,382.62;
  • An agreement with the City of Cumming for sewer for 84,000 gallons per day (gpd) with authorization for the Department of Water and Sewer to purchase the sewer capacity from the City of Cumming at a rate of $30 per gallon;
  • An approval of updated modifications to the existing County Vehicle Replacement Policy;
  • Approval of EMS Affiliation Agreements with Emory Johns Creek Hospital (EJC) and Central Emergency Medical Services that will allow new recruits to obtain the required clinical hours and skills checks required by the state of Georgia;
  • Request for authorization to apply for the FY2020 grant to replace old gear, washer-extractors, and dryers whose useful life have expired in the amount of $67,795, which includes Federal Funding Assistance in the amount of $61,632, with a required match of $6,163;
  • Approved a Budget Resolution in the amount of $22,500 to allocate insurance proceeds towards the replacement of one Sheriff’s Office Total Loss Vehicle;
  • Approved Board generated rezoning for ZA3919, The Estate of Paul Harley Reed, Jr. In accordance with UDC 8-5.5(I);
  • Approved amendments to the Unified Development Code related to Public Participation Meeting Requirements;
