Taylor Morris conservation subdivision will add 93 single-family homes

FORSYTH COUNTY, Ga. – Planning Commission concerns aside, the Board of Commissioners moved forward Thursday to unanimously approve a conservation subdivision in North Forsyth that will add 93 homes to the community.

The Planning Commission recommended denial of Taylor Morris request to rezone the property at 4850 Burruss Road from agriculture district (A-1) to single family residential (R-2) at its last meeting in October and when the development was first proposed to the Board of Commissioners in November, they appeared not to like it either.

“Let’s lay our cards on the table,”said attorney Ethan Underwood who represents Taylor Morris. “The feedback we got was you all hated it.”

So Underwood came to last week’s meeting to present a new site plan that would require the following variances:

  • A reduction in the minimum number of lots abutted by open space on one side from 85 percent to 43 percent;
  • A reduction in the minimum setback from primary conservation area from 75 feet to 0 feet;
  • A reduction in the minimum percentage of total land area required as open space from 40 percent to 39 percent.

Commissioners added a condition of their own that requires the district’ commissioner to view the site plan’s amenity area pool and the associated cabana.

Fill Ministeries withdrew its request for a conditional use permit (CUP) without prejudice.

 

 

Board of Commissioners delays decision on Hindu Center of Atlanta

FORSYTH COUNTY, Ga. – The Board of Commissioners voted to postpone a proposal to revoke a request by the Hindu Center of Atlanta for a Conditional Use Permit (CUP) to construct a worship center and priest’s residence on 6.85 acres located at Kelly Mill Road until Oct. 7.

As an alternative to revocation, the Board proposed adding more than 20 restrictive conditions. But attorney Ethan Underwood said neither he nor his client had been made aware of the proposed conditions prior to the meeting. He also said his client had not received a citation although he acknowledged the client had been issued a warning for occupying a building that “suspiciously” burned to the ground without a certificate of occupancy.

Fire Chief Barry Head and Investigator and Scott Anderson said the fire was not suspicious but was the result of an overhead electrical failure. Several people who live near the property said they had called numerous times to complain about noise and lighting but never received a response.

Commissioners agreed to move the agenda item until later in the meeting to give Underwood time to review the proposed conditions. He returned near the end of the meeting to state his client could not agree to several conditions and commissioners then voted to postpone the hearing for two weeks.

In other decisions, the Board:

  • Voted unanimously to revoke an existing CUP in accordance with UDC Section 8-5.5(I) – Parcel 043-077;
  • Approved an Alternate Design for McFarland Road Associates, LLC and a variance to UDC 21-6.5 and to rezone from Commercial Business District (CBD) and Restricted Industrial District (M1) to Commercial Business District (CBD) on 17.582 acres with a Conditional Use Permit (CUP) for a 44,050 sq. ft. expansion of a Mercedes vehicle sales dealership in addition to existing buildings totaling 81,231 sq. ft. with 397 parking spaces with four;
  • Approved a Sketch Plat for KC Property Holdings LLC and variances to UDC 18-11.2(A), UDC 18-11.2(B), UDC Table 14.2, UDC Table 21.6, UDC 21-6.5(A)(2), UDC 21-6.5(D)(1), and UDC 14-4.13;
  • Approved amendments to the Alcohol Ordinance to include allowances for delivery of alcohol, to-go packaged alcohol, mixed drinks to-go, manufacture increased production and sales limits, renewal of conditional license and to repeal conflicting Ordinances.

Under Old Business, the Board approved WP South Acquisitions, L.L.C. to rezone from Multi Family Residential District (RES6) and Commercial Business District (CBD) to Master Planned District (MPD) on 51.72 acres for 310 attached residential units with a density of 6 units per acre and commercial buildings totaling 39,100 sq. ft. with 172 parking spaces with variances.

Under New Business, the Board:

  • Approved Matt Sosebee’s request to rezone from Agricultural District (A1) and Neighborhood Shopping District (NS) to Agricultural District (A1) with a Conditional Use Permit (CUP) for an open storage yard with 276 parking spaces on 9.673 acres with the following variances to reduce the zoning buffer adjacent to tax map/parcels 291-028 and 291-173 from 25 ft. to 0 ft. (UDC Table 15.2); and the zoning buffer adjacent to tax map/parcel 291-027 from 25 ft. to 0 ft. (UDC Table 15.2) – Parcels 291-025 and 291-045;
  • Approved a request by Nitsye LLC to rezone from Agricultural District (A1) to Commercial Business District (CBD) on 1.719 acres for an 8,732 sq. ft. r retail/office/veterinary clinic without outdoor facilities with 35 parking spaces with a variance to eliminate the 5,000 ft. sewer distance requirement to facilitate the use of an on-site septic disposal system (UDC 18-5.18) – Parcel 202-016;
  • Approved sending a County-Initiated Conditional Use Permit (CUP) for agritourism – Parcels 221-705, 221-754, 221-535, and 221-777 to a future public hearing;
  • Approved sending a County-Initiated Conditional Use Permit (CUP) for agritourism regarding Bottoms Tree Farm to a future public hearing;
  • Approved an amendment to the Accountability Court Defender Agreement to become effective Oct. 1;
  • Approved an agreement regarding Exchange of Right-of-Way or Interests in Land between Forsyth County and Brookview, LLC and associated Quit Claim Deed.

The Board also conducted an Administrative Hearing during which it issued a warning to VL Business, Inc. and named licensee Vasudev Patel for a violation of the alcohol ordinance.

 

 

 

 

 

 

 

 

Levent blames zoning attorney for postponements in Ronald Reagan Corners LLC development

FORSYTH COUNTY, Ga. –District 3 Commissioner Todd Levent pushed back Friday regarding attorney Ethan Underwood’s assertion that the Board of Commissioners is “trying to force his client to agree to architectural standards not in the (Uniform Development) code.”

During the Public Comment portion of the commission meeting Thursday, Underwood expressed frustration over the second postponement of a sketch plat approval for Ronald Reagan Corners LLC, a 72,000 square foot development consisting of office, retail and restaurant space at the intersection of Ronald Reagan Blvd. and Atlanta Road. Underwood said the delay is costing his client money and “making the county making the county be an unpredictable place to do business.”

The proposed development is in Levent’s district. During a phone interview Friday, Levent said Underwood is wrong. “The original conditions give the district commissioner architecture control, He didn’t mention that. His scenario only applied to the sketch plat.”

In an email sent to Levent Friday, Planning and Community Development Director Tom Brown supported the commissioner’s position and provided the wording of Condition No. 6 from original zoning, ZA 2352:

“Prior to any construction permits being issued, a site plan shall be submitted to the district Commissioner for approval. The site plan will show the type of businesses proposed, hours of operation, landscaping, building exterior finish descriptions with colors, and any other items deemed appropriate by the Commissioner.”

Brown further stated that “the proposed Sketch Plat must be in compliance with all other Forsyth County ordinances, including the Tree Ordinance and it appears Tree Ordinance has been given no consideration in the proposed design of the site.”

Although he strongly objects to Underwood’s statements, the commissioner said he is open to working with Underwood and all zoning attorney to build a better quality of life in Forsyth County.

BLM protest draws fire from Forsyth County Republicans

FORSYTH COUNTY, Ga. — Local Republican leaders were quick to condemn the action of the left-wing radical group Black Lives Matter that brought a halt to Sen. Kelly Loeffler’s trip to Forsyth County on her All About America bus tour Thursday.

Before her speech to supporters at the Sawnee Mountain Park Community Center was halted by BLM activists Loeffler blasted protesters.

“You have seen the left move swiftly, radically, violently. You couldn’t imagine it, but this year, 2020, they want to replace American ideals literally with socialism,” she said. “They’re looking to replace not just our freedom and our Constitutional rights but our way of life.”

Moments later she was shouted down by chants of “Black Lives Matter” and “No Justice No Peace.”

Forsyth County Republican Party Chairman Patrick Bell said, “So chanting, interrupting and even threatening people is how the left intends on making this a better country. As we have seen several times this week, Republicans in this state are being recognized for real measurable successes for all citizens. Democrats…not so much.”

District 24 State Rep. Sheri Gilligan added, “Republicans had a great opportunity to hear directly from their senator. Unfortunately Democrat activists shouted down any ability to have a free exchange of ideas. Everyone agrees the lives of black people/people of color matter. Americans also agree we have room for improvement. The cancel culture movement harms its own message when their messengers are bullies. Brow beating is not debate. I admire (Loeffler’s) courage under fire and maintaining her composure.”

County Commissioner Molly Cooper stated, “The repetitive chant of “Black Lives Matter” continued in response to Senator Kelly Loeffler after she stated emphatically that black lives most certainly do matter and there is no place for racism in our country. It was such a shame that the Black Lives Matter chanters were deaf to what Senator Loeffler passionately emphasized. Regardless of the chants, or the refusal by the Black Lives Matter chanters to engage in discussion, we had a terrific meet and greet and if anyone was ‘on the fence’ about voting for Senator Loeffler, the Black Lives Matter chanters accidentally encouraged them to choose the compassionate, strong, conservative woman that does not back down. Thank you to the Black Lives Matter chanters.”

Former GOP Chairman Ethan Underwood, who campaigned unsuccessfully for 9th District U.S. Congress this year, said, “It’s ironic that freedom of speech is being used to drown out civil discourse.”

Thursday’s protest infuriated Loeffler’s supporters who responded with chants of “All Lives Matter” and “Kelly, Kelly.” While several people confronted the protestors face-to-face, the confrontation did not escalate into violence. About a dozen Forsyth County Sheriff’s Office deputies were stationed inside and outside the facility but were unable to intervene because the event was held at a public park.

Loeffler was never allowed to resume her speech. Before leaving along with Arkansas Senator Tom Cotton for the next stop on her All About Georgia bus tour (Hall County), Loeffler spoke briefly with reporters outside the community center, stating that she has proposed legislation that would withhold funding from district attorneys who refuse to prosecute crimes that arise from protests.

“It applies to any rioters, looters, arsonists, anything that is unlawful,” she said. “We have to enforce the law. We have district attorneys who are not enforcing the law. We have to make sure they are accountable.”
